My Employer or Their Third-Party Administrator (TPA) Has Asked Me To Give a Recorded Statement. Do I Have To Cooperate?

Your employer or TPA has the right to interview injured workers and gather information about a claim. A recorded interview is one way to preserve important information; however, an employer or TPA cannot record a worker without his/her permission or require a recorded interview in order to open a claim or pay benefits. A worker's refusal to be recorded is not a permissible reason by itself to reject or suspend a claim. If a worker objects to a recorded statement, taking detailed interview notes can be equally effective.
