What Is Considered Employer Retaliation or Discrimination After I Have Filed a Workplace Injury Claim?
The following may be employer retaliation or discrimination for filing a workers' comp claim:
- Firing you or laying you off.
- Demoting you or assigning you to an undesirable shift.
- Expecting you to work beyond your doctor's prescribed restrictions.
- Denying you a promotion.
- Reducing your wages and/or benefits.
The law does not prevent an employer from taking action against a worker for other reasons, including but not limited to failure to follow employer health and safety standards.
